Terms and Conditions, VILLA MANAAKI

SUBJECT

These general terms and conditions of sale define the rights and obligations of the parties in the context of the remote booking of services offered by VILLA MANAAKI on its website and mobile services and by its partners.

They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties. Any reservation therefore implies the customer’s full and unreserved acceptance of these terms and conditions of sale. The customer acknowledges having read and accepted them. They therefore constitute a contract between VILLA MANAAKI and the customer. The latter acknowledges having the capacity to contract, i.e. being of legal age and not under guardianship or curatorship. VILLA MANAAKI reserves the right to modify and amend the General Terms and Conditions of Sale at any time. The version of the General Terms and Conditions of Sale applicable to an order is that in force on the website at the time of confirmation of the order by the customer (when validating online payment).

RESERVATIONS

Reservations can be made via the website, e-mail, post or telephone. The reservation will be effective only if it is guaranteed by the customer, by paying a deposit of 30% by secure online payment, or by sending a deposit check of 30% and after receiving a detailed booking confirmation. In this case, the reservation becomes firm and effective only on receipt of the deposit by the establishment, within the specified time. The balance of the stay must be paid on site.

REGULATIONS

The reservation becomes effective once the customer has paid the deposit of 30% of the cost of the stay. Such payment constitutes full acceptance of these terms and conditions of sale. Reservations are for 2 adults only. The balance will be paid when the keys are handed over. Payment methods :

RATES

The rates shown on our site are in EUROS and include all taxes, but exclude tourist tax.

The price indicated to the customer at the time of booking is binding and cannot be modified under any circumstances, unless the customer changes the booking parameters.
Any additional services provided by the establishment during your stay and, if applicable, the tourist tax will be added to the price mentioned in the reservation.

The prices applicable are those in force on the day of booking. Only the price indicated in the booking confirmation is binding.
The Taxe de Séjour is updated every year, and is charged per night and per person over 18 (in 2023: €0.80/person/night).

CANCELLATION OR MODIFICATION

Cancellation of a reservation must be notified by e-mail to contact@villa- manaaki.com. The request will only become effective once the establishment has confirmed its acceptance in writing.
In the event of cancellation by the customer less than 14 days before the date of arrival, the deposit paid at the time of booking will not be refunded, unless the cancellation is due to force majeure. Promotional and non-cancellable bookings are non-refundable.

FORCE MAJEURE

Force majeure is defined as any event external to the parties that is unforeseeable, insurmountable and prevents either the customer or the establishment from fulfilling all or part of the obligations under the contract.
Cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of French courts.

Each party shall not be liable to the other party in the event of non-performance of its obligations resulting from an event of force majeure.
It is expressly agreed that in the event of force majeure, the parties shall suspend performance of their mutual obligations and that each party shall bear the costs arising therefrom.

RESPONSIBILITIES

We cannot be held responsible for loss, theft or damage to personal belongings on the entire site, both inside and outside the facilities. The customer is responsible for the safekeeping of his belongings. We cannot be held responsible for the disappearance of valuables or jewelry left in the room. We recommend you take them with you.

A safe, not insured, is available in the rooms.
The customer must inform the establishment of any damage caused by him/her. He/she is responsible for all damage caused by him/her, both physical and material (in rooms, common areas such as the swimming pool, kiosk, garden, outdoor lounge, veranda, sanitary facilities) and undertakes to pay the cost of repairing any damage to the premises made available to him/her. The customer may be held liable for damages.

when the establishment has confirmed its acceptance in writing.

Also, any behavior contrary to public decency or order, or considered as endangering the life of others, will lead the establishment to ask the customer to leave the establishment without any compensation or refund if payment has already been made. If no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.

The customer agrees not to invite any person whose behavior is likely to be prejudicial to the establishment, which reserves the right to intervene if necessary.

VILLA MANAAKI offers free WIFI access for guests to connect to the Internet. The customer undertakes to ensure that the computer resources made available by the establishment will not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required. Should the customer fail to comply with these obligations, he or she may be charged with counterfeiting (article L.335-3 of the French Intellectual Property Code), punishable by a fine of 300,000 euros and three years’ imprisonment. The customer is also obliged to comply with the security policy of the establishment’s Internet service provider, including the rules governing the use of security measures implemented to prevent the unlawful use of IT resources, and to refrain from any action that undermines the effectiveness of these measures.

GIFT CARD

The gift card is valid for 12 months from the date of purchase online. The full amount of the holiday offered must be paid when the order is placed.
Under no circumstances can a refund be requested.
All extension requests must be made within the card’s validity period and must be approved by us. After the one-year period, the gift card will expire and will not be eligible for a refund or extension of the validity date.

As a reminder, all sums paid for the purchase of an unused gift card will be retained.

WELCOME – INFORMATION

Arrivals are from 3 pm to 7 pm. Departures before 11 am. We take care of cleaning at the end of your stay. Only the studio kitchen is to be left in its original state, with dishes put away and the fridge emptied and cleaned. We can store your luggage free of charge for the day.

GENERAL PROVISIONS

– Rooms and ancillary facilities (swimming pool, garden, kiosk, parking lot) are strictly reserved for guests and are their sole responsibility.

Under no circumstances may the premises be used by third parties.

The occupation of rooms by third parties is forbidden, under any pretext whatsoever, even free of charge, on pain of termination of the contract. The full amount of the stay will be retained by the service provider.
– It is forbidden to eat or store food in rooms, with the exception of the Filao studio.

– Smoking is restricted to the terraces and verandas, and ashtrays are available. The veranda used for breakfast is non-smoking.
– For longer stays, room cleaning and change of bed linen is provided every 6-7 days. Bath linen is changed every 3-4 days.

– The cyclone season in Réunion runs from December 15 to March 15. In the event of a cyclone, the supply of water and electricity may be interrupted without the service provider being held responsible. The customer may not invoke this to terminate the sales contract. A cyclone is not a case of force majeure.

– The swimming pool is open from 9am to 7pm, for hotel guests only.
– Pets are not allowed on site.
– Between 7 p.m. and 8 a.m., please respect everyone’s peace and quiet.

PARKING

Free unguarded private parking is available on site. We accept no responsibility for theft or damage.
We ask you to keep your speed down and not to park in the way of other vehicles.

SAFETY – EMERGENCY NUMBERS

For your safety, we ask you to read the safety instructions posted on the veranda and in each accommodation. A list of emergency numbers is included.

DISPUTES OR CLAIMS

Any complaint relating to the stay must be sent by registered letter, with acknowledgement of receipt (AR), within 7 days of the stay, to the following address: VILLA MANAAKI, 23 Chemin de la piscine, 97411 Bois de Nèfles Saint- Paul.

These General Terms and Conditions of Sale are governed by French law. For all disputes arising from the execution or interruption of the present contract, only the Courts of the jurisdiction of the location of the chambre d’hôte are competent.
